Welcome to Avenue. These Terms of Service (“Terms”) govern your use of the Avenue website and SMS/iMessage service (the “Service”) provided by Avenue Labs (“Avenue,” “we,” “us”). By using the Service, you agree to these Terms.

Eligibility

You must be at least 18 years old to use Avenue. By signing up, you confirm that the phone number you provide is yours and that the information you share with us is accurate.

The service

Avenue helps you discover NYC apartment listings based on the preferences you share over text. We don’t own or list the apartments ourselves; listing details come from third-party sources and may be inaccurate, outdated, or unavailable. Always verify listings directly with the broker, landlord, or property owner before signing a lease or sending money.

Messaging

By providing your phone number, you consent to receive automated and human-sent text messages from Avenue related to your search. Message and data rates may apply. You can opt out at any time by replying STOP, or get help by replying HELP.

Acceptable use

Don’t use the Service for unlawful, harmful, or abusive purposes.
Don’t scrape, copy, or resell our listings or content.
Don’t attempt to disrupt, reverse engineer, or access the Service in unauthorized ways.
Don’t impersonate others or provide false information.

No broker relationship

Avenue is not a real estate broker or agent and does not represent you in any transaction. We don’t provide legal, financial, or real estate advice.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We don’t guarantee that listings are accurate, available, or suitable for you, or that the Service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Avenue and its affiliates won’t be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability for any claim relating to the Service is limited to one hundred U.S. dollars (US $100).

Termination

You can stop using the Service at any time by replying STOP to our messages or emailing us. We may suspend or terminate your access to the Service at any time if we believe you’ve violated these Terms.

Changes

We may update these Terms from time to time. If the changes are material, we’ll update the effective date above and, where appropriate, notify you. Continuing to use the Service after the changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in New York County, New York.
